The Safeguard American Voter Eligibility (SAVE) Act (also known as the SAVE America Act) is a federal legislative proposal designed to prevent non-citizens from voting in federal elections.

Key Provisions

  • Proof of Citizenship: Amends the National Voter Registration Act of 1993 to require "documentary proof of U.S. citizenship" (DPOC) to register to vote.
  • National Photo ID: Mandates a strict photo ID requirement at polling places for all federal elections.
  • Acceptable Documents: Valid proof includes a U.S. passport, a birth certificate, or specialized REAL IDs that specifically denote citizenship status.
  • Voter Roll Purges: Requires states to perform frequent maintenance to remove non-citizens from registration lists.
  • Criminal Penalties: Establishes penalties for election officials who register individuals without the required documentation.

Current Status (February 2026)

  • House of Representatives: Passed on February 11, 2026, with a 218–213 vote.
  • Senate: Faces significant opposition and an uphill battle to reach the 60-vote threshold required to overcome a filibuster.
  • Debate: Proponents argue it is essential for election integrity, while critics contend it creates barriers to voting for millions of eligible citizens who may lack ready access to specific documents.
